(b) An oral report from the Vice-Chancellor on guidance from the Charity Commission on engagement with the EU Referendum, published at  HYPERLINK "https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/505670/eu_referendum.pdf" https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/505670/eu_referendum.pdf setting out thresholds necessary to justify charitable activity on the issue, emphasising the need to ensure that political activity undertaken by charities be undertaken in the best interests of the charity as a means to an end and not as an end in itself. (c) An oral report from the Pro-Vice-Chancellor (External Engagement), outlining the likely impact of exit from the EU by the UK on HEIs, and highlighting key features of the report. (d) An observation from Professor Cathia Jenainati that an exit from the EU would negatively impact colleagues from EEA countries other than the UK in terms of ease of movement for research purposes. (e) An observation from Professor Abhinay Muthoo that British exit from the EU would reduce scholarly exchange, and therefore the ability of academia to solve global problems. (f) Observations from Professor Jan Palmowski that the UK currently had the ability to influence research funding allocation in Europe, and that the collaborative benefits of EU membership to University research were considerable. (g) In response to a query from Professor Saul Jacka as to whether the Vice-Chancellor had been invited to add his name to the list of 103 Vice-Chancellors who had published a letter in the Sunday Times advocating the advantages of continuing EU membership for the UK university sector, that he had been invited, but had felt it inappropriate to add his name pending the debate by the Senate. (h) An observation from Professor Sean Hand that universities were moral, social and civilising forces, and the University should therefore declare its position against leaving the EU as a clear signal of the values espoused by the institution and exemplified in the pursuit of its teaching and research activities. (i) In response to requests from Miss Mia Khan that it would be advisable to put data in the public domain of the sort that was not typically provided by the media illustrating the tangible benefits of EU membership to the Universitys educative purpose, and that the University should work to encourage students to participate in the referendum, that partnership with the Students Union would be a characteristic of the Universitys approach. (j) An observation from Mr Isaac Leigh, that the Students Union had been waiting for Charity Commission guidance prior to taking any action, that it was highly likely that the Students Union would campaign for the UK to stay in Europe, it being noted that EU students would not have a voice in the referendum. (k) An observation from the Deputy Registrar that in accordance with advice from the Charity Commission, charities should not spend more than 10k on campaigning during the referendum period (15 April 23 June) before registering with the Electoral Commission to become a registered campaigner and noting that such campaigners would be subject to rules on spending and donations. RESOLVED: That in accordance with the views expressed at the meeting, the University should confirm its position as being strongly supportive on academic grounds of the UKs continuing membership of the EU. 54/15-16 Professor Sir Christopher Zeeman, FRS REPORTED: The sad news that Professor Sir Christopher Zeeman, Founding Professor of the Department of Mathematics at the University of TV, passed away on 13 February 2016. Note: A moment of silence was held in memory of Professor Zeeman. 55/15-16 Minutes RECEIVED: (a) The draft minutes of the meeting of a joint meeting of the Council and the Senate held on 14 October 2015, which would be approved at the next joint meeting. CONSIDERED: (b) The minutes of the meeting of the Senate held on 27 January 2016, noting the following interventions: An observation from Mr Nat Shiers regarding Minute 37/15-16 (k), indicating that he had made a formal request on behalf of the Students Union at the previous meeting of the Senate that the University should publish documentation demonstrating its compliance with the Prevent duty and reporting how it was training members of the community accordingly, and noting that this request remained outstanding. In response to an observation from Professor Saul Jacka regarding Minute 37/15-16 (f), that the degree of academic freedom enshrined in Statute 24 Academic Staff, to which he had been directed following his previous intervention could not be regarded a sufficiently detailed commitment to freedom of speech, not least since it was silent on freedom of speech for students, that this point was well made and further consideration would be given to it in the consideration of Statute 24. In response to an observation from Miss Mia Khan regarding Minute 37/15-16 (g) and (h), indicating that her expectation had been that the Senate would reconsider the Universitys response to the Prevent duty, that approval of the Universitys strategy on Prevent lay with the Steering Committee. 56/15-16 Matters Arising on the Minutes REPORTED: Progress of Senate Recommendations Revisions to University Ordinances That the Council, at its meeting on 10 February 2016, had noted the report from the meeting of the Senate on 27 January 2016 and had approved the recommendations of the Senate recorded under the following items: Proposed amendment to Ordinance 7, Constitution of the Boards of the Faculties, for the first time, as set out in paper S.31/15-16 (minute 42/15-16 referred). Proposed amendments to Ordinance 16, governing the Payment of Annual Fees, Residential Charges and Other Debt, for the second time, as set out in paper S.24/15-16, incorporating further changes approved by the Vice-Chancellor and reported under Chairs Action (minute 49/15-16 referred). Progress of Senate Recommendations: Revisions to University Regulations That the Council, at its meeting on 10 February 2016, had noted the report from the meeting of the Senate on 27 January 2016 and had confirmed the recommendations of the Senate recorded under the following items: Proposed amendment to Regulation 37 governing Taught Postgraduate Courses as set out in papers AQSC.5/15-16 and BGS.7.15-16 (minute 41/15-16 (a) referred). Proposed amendment to Regulation 11 on the Procedure to be Adopted in the Event of Suspected Cheating in a University Test as set out in paper BGS.11/15-16 (minute 41/15-16 (c) referred). 57/15-16 Chairs TV: Change of Role REPORTED: That the Chair had enjoyed the experience of his first weeks in his new role as Vice Chancellor; that challenges had been identified and that he felt it was important to create space for discussion and engagement. 58/15-16 Chairs TV: Queens Anniversary Prize REPORTED: That the Queens Anniversary Prize for Higher and Further Education, awarded for research in Mathematics and Statistics and the impact and application of that research to solve global challenges, had been a marvellous recognition of the Universitys continued success in this field, which he had been proud to accept on behalf of the University alongside the Chair of the Department of Mathematics. 59/15-16 Chairs TV: HEFCE Grant Letter REPORTED: That the HEFCE grant letter had been received against the backdrop of significant flux in the sector arising from the recent BIS Green paper and that key points in the letter included: There would be a re-targeting of student opportunity funding with a decrease of 50% in available funding. It would be the responsibility of the HEFCE to deliver the Teaching Excellence Framework which would require significant work on metrics. A reiteration of the Green Paper target on student mobility and the proposed increase of 20% in BME students by 2020. A need to render more coherent and meaningful the significant quantity of data available for (potential) students. A renewed emphasis on the importance of degree apprenticeships. A likely increase in levels of engagement and collaboration with the business community expected from HEIs with the retention of HEIF. Confirmation of the continuation of the dual support structure for research; a ring-fencing of the research budget to 2020; a renewed emphasis on open access and a re-stating of the Nurse recommendations. 60/15-16 Chairs TV: Conferral of Emeritus Status on Professor Ann Caesar REPORTED: The intention to confer emeritus status on Professor Ann Caesar, Professor of Italian, upon her retirement at the end of the current academic year, in recognition of her significant service to the University over many years. 61/15-16 Chairs TV: Appointment of the Chair of the Faculty of Medicine REPORTED: That, further to the news reported to the last meeting of the Senate that Professor Peter Winstanley was to retire from his post as Chair of the Faculty of Medicine in May, interviews for his successor would be held on 10 March 2016. 62/15-16 Chairs TV: Appointment of Registrar REPORTED: That the role of Registrar would shortly be advertised and that academic members of the Senate with an interest in joining the joint committee of the Senate and the Council which would oversee recruitment to the post should contact the Vice-Chancellor. 63/15-16 Registrars TV: Results of Students Union Elections REPORTED: That the provisional outcome of elections for the Students Unions Sabbatical Officer team for the academic year 2016-17 had been announced, noting that these were provisional results until formally ratified by the Elections Adjudication Panel: President - Luke Pilot Democracy and Development - Becky Gittens Welfare and Campaigns - Chloe Wynne Education - Hope Worsdale Postgraduate - Nat Shiers Sports - Ted Crowson Societies - Marissa Beatty RESOLVED: That the congratulations of the Senate be extended to the new Sabbatical Officer team for 2016-17. 64/15-16 Registrars TV: Appointment of a New Chancellor REPORTED: That Sir Richard Lambert had announced his intention to retire from the post of Chancellor of the University and that three academic members of staff would be invited to serve on joint committee of the Senate and Council which would oversee recruitment to the post. 65/15-16 California RECEIVED: An oral report from the Vice-Chancellor on developments in California, noting: That the main investors had decided to fund the loan sought to meet the costs of work to be undertaken over the next c. 20 months, interest-free. That an activity plan for the various workstreams would be designed in the coming months which would be brought for consideration to the Senate at its meeting on 8 June 2016. 66/15-16 *Prevent Duty and Counter Terrorism Act CONSIDERED: (a) A paper and oral report from the Deputy Registrar setting out progress towards compliance with the Universitys Prevent Duty, (S.39/15-16), {Restricted}, inviting the Senate to consider revisions to University Regulation 31, governing the Use of University Computing Facilities; note ongoing work in relation to revision of University Regulation 29, covering Meetings on Campus and the processes for the approval of external speakers at University events and to note further updates with respect to work in relation to the Prevent Duty specifically communication via the Prevent website which was due to be launched imminently and engagement plans and staff training. (b) An observation from Professor Freely, that she had put herself forward as a trainee in the Prevent Duty, and that it would be useful for other members of the Senate to do so in order to be able to speak from a more informed perspective on the issues. In response to an observation from Professor Saul Jacka with respect to the amended Regulation 31.5.1.1 that the word inappropriate to describe materials intended to be the subject of the clause be deleted, with the remaining descriptors left in place; and the phrase () material that could be considered inappropriate () was too broad and should be replaced with which is at risk of drawing people into terrorism. In response to an observation from Miss Mia Khan that she felt the definition of the term extremism in the Regulation to be unnecessary, that this had been included on the advice of the Universitys solicitors, but could be reviewed and brought back for consideration at the next meeting of the Steering Committee. In response to an observation from Miss Mia Khan that Regulation 31.2.6 should indicate the range of relevant authorities in addition to the police, that the form of words included had been deliberately chosen so as to avoid a need to revisit the regulation each time a new agency was created or drawn into the ambit of the area covered by the regulation. In response to an observation from Miss Mia Khan that it had been her understanding that the Senate would be asked to consider a further version of the Universitys response to the Prevent duty, that the Senate was reviewing the regulatory aspects of the duty but that it was for the Steering Committee to approve the Universitys approach. In response to an observation from Mr Nat Shiers on the need for transparency through the publication of all documentation setting out the Universitys approach, including information on whether the University intended to complete the voluntary dataset, that the Universitys response would be made available on a dedicated webpage; that the Steering Committee would consider the issue of the voluntary dataset. In response to an observation from Miss Mia Khan that fuller engagement should have been possible despite deadlines and that feedback from the Senate should be reported to the Steering Committee for its consideration, that the University was committed to engagement but the occasional inflexibility of externally-prescribed submission dates constrained to some degree its ability to do so; that the Steering Committee was empowered under its terms of reference to consider appropriate matters between meetings on behalf of the Senate and Council and that the papers submitted to both the January and March meetings of the Senate set out clearly the decisions to be taken by the Senate and reported those already taken by the Steering Committee. In response to a query from Professor Colin Sparrow, that unless or until a revised version of Regulation 29 was approved, the current version would be submitted to HEFCE by the deadline of 1 April. That it be noted that a meeting of the Assembly had been arranged as quickly as possible as requested through appropriate channels in order to provide a further opportunity for engagement with the wider University community RESOLVED: That, subject to consideration of the interventions recorded above, a revised Regulation 31 be submitted to the next meeting of Steering for consideration and approval, it being noted that any further comments could be raised with Professor Colin Sparrow, who served as a representative of the Senate on the Steering Committee. 67/15-16 Strategy Goal Report CONSIDERED: A paper providing an update on progress made towards Strategic Institutional Goals (S.40/15-16), together with an oral report from the Deputy Registrar noting that the paper had been presented to the Senate to enhance the visibility of the work of the programme boards and to inform investment decisions through the planning round. In response to an observation from Professor Aileen Clarke regarding the RAG assessment of work planned in fulfilment of Objective Five of Strategy Goal 2 (Ensure that staff, students, teaching and research all have a positive impact on society at large, that this area would be prioritised. 68/15-16 The Abolition of Student Maintenance Grants CONSIDERED: A paper from the Students Union proposing that a statement of opposition to the recent abolition of student maintenance grants be developed (S.50/15-16), together with an oral report from the President of the Students Union, reinforcing the Students Union view that the abolition of maintenance grants would negatively impact a number of student groups. An observation from Professor Colin Sparrow, that the Senate did not have the power to direct Vice-Chancellor as to matters on which he might make a public statement. An observation from Professor Maureen Freely, that the Senate ought to take and publish a principled stance on matters adversely affecting students. An observation from Professor Christina Hughes, that data showed that the introduction of loans had not resulted in reduced numbers of applications from groups of students thought most likely to be impacted; that Government policy was increasingly informed by these data and that universities charging fees above 6k per annum were expected to make a significant investment in WP activity. An observation from Mr Luke Pilot that the abolition of maintenance grants was likely to affect retention of students, and the quality of the student experience, rather than applications. In response to a point of order regarding his role as Vice-Chancellor and as Chair of the Senate, that whilst noting that a number of members had spoken against the wording and form of the Students Union motion, he noted a consensus amongst Senators in support of the intention. RESOLVED: That it be recorded that the Senate believes that the abolition of student maintenance grants and the replacement of them with loans will have a negative impact on our educational mission and on student well-being. That the Vice-Chancellor, albeit un-mandated, would articulate this position publically. 69/15-16 External Examining and Pass List Scrutiny CONSIDERED: A paper from the Pro-Vice-Chancellor (Teaching and Learning), proposing changes to the process for consideration of the appointment of External Examiners and Pass Lists, (S.41/15-16). In response to observations from Professor Lesley Roberts, welcoming the proposal, but indicating that the use of the word discipline might be problematic, and indicating that integrated professional programmes did not have modules, that further consideration be given to the specific wording in some areas of the proposal. In response to an observation from Professor Roberts that external examiners should have a valuable role beyond the examination process per se, for example through taking a view of the quality of the course; taking an active role in setting examination paper questions and in speaking directly to students, that more information on this wider role could also be integrated into existing guidance. In response to an observation from Professor Alison Rodger, that she felt there was a need for a central record of external examiners to avoid conflicts of interest, that work was being undertaken in this area to respond to the provisions of the UK Quality Code. In response to a query from Professor Cathia Jenainati, that where there was a particularly small pool of external examiners in the UK, that there was a precedent for appointing external examiners from the EU. In response to an observation from Professor Saul Jacka, that the timeframe for the setting of examination papers often preceded the timeframe for the approval of external examiners, that this would be separately addressed.
